Selangor state executive councillor Nik Nazmi Nik Ahmad was charged in the High Court today with organising a "Black 505" rally without a permit at the MBPJ Stadium in Kelana Jaya, Petaling Jaya, three years ago.
Nik Nazmi, 34, who was charged for the third time on the offence, pleaded not guilty before judge Datuk Ghazali Cha.
Nik Nazmi, who is also the state's Education, Human Capital Development, Science, Technology and Innovation Committee chairman, was charged with failing to give at least 10 days' notice to the Petaling District police of the rally, which was held at the stadium at 8.30pm on May 8, 2013.
Nik Nazmi, who is also head of PKR's Youth wing, was charged for the first time on May 17, 2013. He then applied to have the charge set aside but was denied by the Shah Alam High Court on November 1, 2013.
On April 25, 2014, the Appeals Court had allowed Nik Nazmi's appeal to
strike out the charge.
Nik Nazmi was first charged on February 6, 2014 but on May 6, 2014, the Petaling Jaya Sessions Court acquitted him based on the Appeals Court decision.
However, the Appeals Court in another case decided the 10 days' notice was a must, causing Nik Azmi to face the charge again.
In today's proceedings, the court set February 19 for re-mention and June 13 to June 16 for trial. Bail was allowed at RM1,000 in one surety.
Nik Nazmi's counsel Syahredzan Johan when met afterwards said he would be filing an application this week to strike out the charge.
